Terms of Use

TravelShack offers a variety of tours, activities, products, and services through its website (TravelShack.com). The terms "we", "us", "our" and "TravelShack" refer to TravelShack, LLC. The term "you" refers to the customer visiting the TravelShack website or booking a reservation through us.

These Terms & Conditions contain legal obligations, and your use of our website and your purchase or receipt of bookings from TravelShack are governed by these terms. By visiting the website or using the services in any manner, you agree that you have read and agree to be bound by and a party to all of these Terms & Conditions.

The person making the booking shall be deemed to have accepted these conditions on behalf of the persons named in the booking.

Any terms stated by TravelShack on its website, emails, or in any other written form that are for specific activities supersede any contradicting terms in this document.

No variation to these Terms & Conditions shall be of any effect unless made in writing by and with the authority of TravelShack. TravelShack may change these Terms & Conditions at any time by posting changes online.

You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use TravelShack.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of TravelShack.com content requires the prior written permission of TravelShack.

You agree to use TravelShack.com only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of TravelShack.com.

Your use of TravelShack.com is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this site to make any speculative, false or fraudulent requests. You agree not to use robots or other automated means to access this site, unless specifically permitted by TravelShack.

Booking Availability

TravelShack does not guarantee the availability of activities. The booking calendars are generally accurate, but your booking is not complete until you receive an email explicitly stating that the booking has been confirmed. In some cases, the requested date/time may not be available, in which case you will be given the opportunity to request another date/time, or your booking request will be cancelled/refunded.

Booking Redemption

At the time of your activity date, you may be required to provide a form of identification and/or your TravelShack receipt (electronic is sufficient).

Booking Changes

Requests for modifications/amendments should be directed to TravelShack, which will process the request, and are subject to availability. Change requests must be made prior to the stated cancellation cut-off stated for the activity. If necessary, any change requests made after the cancellation cut-off should be made directly with the vendor, and it may be declined with no refund given.

Occasionally our vendors make changes to dates, prices, inclusions, coverage, age requirements, etc. Although TravelShack makes a concerted effort to keep all the information on its site up-to-date, TravelShack reserves the right to cancel, change, or substitute any service, tour, voucher, or product that you have booked at TravelShack.com at any time for any reason, although an effort will be made to communicate such changes to all impacted customers if it's a substantive change. In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price.

Booking Cancellations

The cancellation policy varies by activity, and it is clearly stated on the activity page, the checkout page, and the confirmation email. Any cancellation requests, change requests, or no-shows after the cancellation cut-off time are non-refundable unless the vendor and TravelShack decides to make an exception for you, which they may on a case-by-case basis. If it is due to illness, you may be asked to provide a local doctor's note. Weather cancellations are always refundable or can be rescheduled pending availability.

If you cancel a booking and receive a refund, the number of reward points you earned for that booking will be subtracted from your available points balance. If you do not have enough points in your balance because you have already redeemed them for cashback or credit rewards, the equivalent amount for those redeemed rewards will be recharged to your card on file. 

Best Price Guarantee

TravelShack strives to provide you the lowest booking price, as well as avoids hidden booking fees.

If you find a lower published price available to the public, we will attempt to match it or refund you the difference if you have already paid. Time-limited coupons or promotions do not count; only the selling price for the specific activity and details (e.g., date, time, group size) offered on TravelShack. You must report the better price before the non-cancellation period has commenced and certainly before completing the activity. TravelShack reserves the right to not match the other price and simply refund/cancel your booking if desired.

Payments & Disputes

At the time of booking checkout, you are given the option to Pay Now or Pay Later. Either way you need to provide a valid credit card in order to make a booking. Pay Now means your card will be charged immediately; if any of it is refunded for any reason in the future, the 2.9% credit card fee not returned to TravelShack will be deducted from the refund. Pay Later means your card will be saved on file and charged closer to the activity date, usually about 5 days prior. If the charge fails, you will be invoiced to pay with a new credit card or your booking may be cancelled if you do not respond in a timely manner.

TravelShack's charge on your card statement will not include your activity's name (due to space constraints of your financial institution). If you are unclear what the charge is far, you are responsible for contacting us to inquire, although a quick search of your emails for TravelShack correspondence should provide that answer.

The credit card dispute process is only intended as a last resort if you contact us and are unable to get your question or issue resolved in a timely manner (please allow 2-3 business days, although responses are usually much sooner). If you initiate a credit card dispute without contacting us, or if you initiate a dispute without any merit or clearly not in good faith, TravelShack reserves the right to levy a 10% fee due to the additional time and financial risk that unfairly poses for our company, regardless of the outcome of the dispute process. There is abuse of the credit card dispute process which creates an unfair burden on small businesses like TravelShack, and this penalty is designed to deter unnecessary disputes and to recoup the loss of time and money caused by the dispute process, especially when TravelShack was at no fault.

Rewards

TravelShack credit may only be used for future bookings.

Cashback will be applied to the customer's credit or debit card that was used for booking.

TravelShack reward points have no value outside of the TravelShack reward program, and the customer should not at any time expect to receive any form of compensation for unredeemed or redeemed points or rewards. TravelShack points and rewards are simply a gift, and they may be retracted at any time at the discretion of TravelShack.

Unredeemed points expire 14 days after the latest activity date. 

The expiration of TravelShack credit is 1 year from when the points were earned.

Disclaimers & Limitations of Liability

Under no circumstances will TravelShack or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of TravelShack.com regardless of the form of action.

TravelShack shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any activity operator or other TravelShack vendor.

Furthermore, TravelShack accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.

You will indemnify and hold TravelShack, its parents, subsidiaries, affiliates, officers, and employees harmless (including, without limitation, from all damages, liabilities, settlements, costs and attorneys' fees) from any claim or demand made by you or any third party due to or arising out of your access to TravelShack's website, use of the products or services offered by TravelShack, your violation of this Agreement, or the infringement by you or any third party using your account of any intellectual property or other right of any person or entity.

TravelShack's content, including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to TravelShack or TravelShack.com is provided "AS IS" and on an "AS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

TravelShack does not warrant that functionality, content or information contained on TravelShack.com will be uninterrupted or error free, that defects will be corrected, or that TravelShack.com or the servers that make it available are free of viruses or bugs.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

Restrictions on Use

You warrant, represent and agree that you will not contribute any Content or otherwise use the Services in a manner that (i) infringes or violates the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party; (ii) violates any law, statute, ordinance or regulation; (iii) is harmful, fraudulent, deceptive, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable; (iv) involves commercial activities and/or sales without TravelShack's prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; (v) impersonates any person or entity, including without limitation any employee or representative of TravelShack; or (vi) contains a virus, trojan horse, worm, time bomb, or other harmful computer code, file, or program. TravelShack reserves the right to remove any Content from the Services at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if TravelShack is concerned that you may have breached the immediately preceding sentence), or for no reason at all. You, not TravelShack, remain solely responsible for all Content that you upload, post, email, transmit, or otherwise disseminate using, or in connection with, the Services, and you warrant that you possess all rights necessary to provide such content to TravelShack and to grant TravelShack the rights to use such information in connection with the Services and as otherwise provided herein.

You are responsible for all of your activity in connection with the Services. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Services. You may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any other user of the Services. Use of the Services to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material (including material that may be considered threatening or obscene), or engage in any kind of illegal activity is expressly prohibited. You will not run Maillist, Listserv, any form of auto-responder, or "spam" on the Services, or any processes that run or are activated while you are not logged on to the Website, or that otherwise interfere with the proper working of or place an unreasonable load on the Services' infrastructure. Further, the use of manual or automated software, devices, or other processes to "crawl," "scrape," or "spider" any page of the Website is strictly prohibited. You will not decompile, reverse engineer, or otherwise attempt to obtain the source code of the Services. You will be responsible for withholding, filing, and reporting all taxes, duties and other governmental assessments associated with your activity in connection with the Services.

Account Termination

We may terminate or suspend your account or ability to use the Site, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. For example, we may terminate or suspend your account or ability to use the Site if you misuse the Site. Any such termination or suspension could prevent you from accessing your account, the Site, your Content, Site Content, or any other related information.

You may terminate the Terms of Service at any time by closing your account and discontinuing your use of any and all parts of the Site.
